The Pacific Forensic Mental Health Practice Ltd., operating under the business name of The Forensic Practice (“TFP”) respects your privacy and is committed to protecting your personal information. This Privacy Policy will inform you as to how we look after your personal information when you visit our internet website located at www.theforensicpractice.com, and all associated sites linked to www.theforensicpractice.com, including without limitation, our Learning Management System (LMS) entitled the TFP Learning Academy and located at (https://tfplearningacademy.docebosaas.com), by its subsidiaries and affiliates (collectively, the “Site“), and all TFP Services (as defined below and in the Site Terms and Conditions). The Site is the property of TFP and its licensors. Through the Site, you have access to a variety of resources and content.

2. Agreement to Privacy Terms

These terms and conditions of use (the “Privacy Terms“) together with the Site Terms and Conditions sets out the basis on which any personal information we collect from you when you interact with us, or that is provided by you through your use of our Site, will be processed by us. The Site is not intended for children or underage individuals (as they are defined in the Laws of applicable jurisdictions), and we do not knowingly collect data relating to children. By accepting this Privacy Terms, you acknowledge that you are of the age of majority in your domicile jurisdiction. 

 

By accessing or using the Site or the content provided on or through the Site, you accept and agree to follow and be bound by the following terms and conditions concerning your access to and use of the Site and the content provided on or through the Site (“Site Terms and Conditions“) and our Privacy Terms. BY USING THE SITE, YOU AGREE TO THESE PRIVACY TERMS, AND SITE TERMS AND CONDITIONS; IF YOU DO NOT AGREE, DO NOT USE THE SITE.

 

The Privacy Terms and Site Terms and Conditions constitute a binding and enforceable legal contract between TFP and you in relation to the use of any services described in the Privacy Terms and Site Terms and Conditions – so please read them carefully.

 

We reserve the right, at its sole discretion, to update, modify, add, or remove, portions of the Privacy Terms and Site Terms and Conditions, at any time, without notice to you. It is your responsibility to check these Privacy Terms and Site Terms and Conditions periodically for changes. The most current version of the Privacy Terms and Site Terms and Conditions can be reviewed by clicking on the “Privacy Policy” and “Site Terms and Conditions” hyperlinks located at the bottom of our webpages. When we make updates to the Privacy Terms and Site Terms and Conditions, we will update the date at the top of this page. By using the Site after a new version of the Privacy Terms and Site Terms and Conditions has been posted, you agree to the terms of such new versions. Refer to section 2 (Modifications) below for more information on our modification and notification practices.

 

You may browse our Site and LMS, at any time, without having to identify yourself. However, when you contact us through our Site, subscribe to our newsletter, register for any of our training services, or use our LMS, or use the services of any third-party service provider engaged by TFP, we will ask you for some Personal Information (as defined below).

 

The Privacy Terms describes how we collect, use, process and distribute your information, including Personal Information, used to access our Services. We will not use or share your information with anyone except as described in these Privacy Terms. The use of information collection through our Services will be limited to the purpose under the Privacy Terms and our Site Terms and Conditions for customers.

 

For the purposes of the Privacy Terms, Personal Information” or “Personal Data” means information that is reasonably capable of identifying a particular individual either alone or when combined with information from other available sources. This may include information such as name, gender, date of birth, postal address, telephone number, audio video recordings, email address, or unique online identifiers. “Other Information” means any information that does not reveal your specific identity or does not relate to an individual, such as usage data not linked to any unique identifiers.

3. What Personal Information does TFP collect and why?

We collect Personal Information from you so that we can provide you with a positive experience when utilizing our Services. We will only collect the minimum amount of information necessary for us to fulfill these Services. We use different methods to collect your information, including through:

 

  • Direct interactions with you when you provide it to us, for example, by corresponding with us by phone, email, or otherwise. 
  • Automated technologies or interactions, as you navigate through our Site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies. Please be advised also that we use Google Analytics to track and report website traffic and that some information may be collected by Google; please consult Google’s privacy policy at https://policies.google.com/privacy for details.  

Please note that the Personal Information that you provide us is voluntary, and by you providing this information to us you are giving your consent for us to use, collect, and process this Personal Information. You may opt-out or request us to delete your Personal Information at any point (see below for further information about your rights). 

 

If you disclose any Personal Information relating to other people while you are using our Services, you represent that you have the authority to do so and to permit us to use the information to provide you the Services requested in accordance with this Privacy Policy.

(a) The Types of Information We Collect

Personal Information does not include data where the identity information has been removed (“Anonymous Data”). We may collect, use, store and transfer different kinds of Personal Information about you which we have grouped together as follows:

 

  • Identity Data includes first name, last name, username or similar identifier, title, and company details.

  • Contact Data includes billing address, delivery address, email address and telephone numbers.

  • Financial Data includes payment card details. Billing information including name, firm or company affiliation, email, mailing address, telephone number and credit card information so that we can process payment to deliver our products or services to you under our contractual obligation. This information may be shared with third parties that provide us e-commerce services. We encrypt credit card numbers using industry standard technology.

  • Transaction Data includes details about payments to and from you and other details of Products you have purchased through our Site.

  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access the Site.

  • Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.

  • Usage Data includes information about how you use our Site, products and services.

  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences. 

  • User Data or User Generated Data means information uploaded and shared by you that includes Personal Information. This includes video or audio recordings, documents or data (“Material”) you provide or upload to our LMS while participating in our Services.

Information Collected Automatically:  As you navigate through and interact with our Site, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Site, including traffic data, location data, and other communication data and the resources that you access and use on the Site. 
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

Anonymous Online Identifiers (IP Address, Devise IDs, etc.): To maintain our Site’s high quality, we may use your IP address to help diagnose problems with our server and to administer the website by identifying which areas of the website are most heavily used, and to display content according to your preferences. Your IP address is the number assigned to computers connected to the Internet. This is essentially “traffic data” which cannot personally identify you but is helpful to us for marketing purposes and for improving our services. Traffic data collection does not follow a user’s activities on any other websites in any way. 

 

Anonymous Location Identifiers: We collect information about your location when you use or access our Services. The degree of precision of the location data varies depending on the source of such information. Those sources include data from your device through settings you activate and other location sources (e.g., IP address). 

 

We collect and use this location-related data in order to:

  • Provide you with Services you have purchased or requested.
  • Deliver content that is relevant to you based upon your location.
  • Deliver marketing or ad content that is relevant to you based on your location.
  • Protect against abuse or misuse of Services or of your account.
  • Improve our Site and Services.

We also collect, use and share Aggregated Data such as statistical or demographic data to deliver our Services, for the purpose of assessing the effectiveness of our Services, and for other research purposes. Aggregated Data could be derived from your Personal Information but is not considered Personal Information in law as this data will not and cannot not, directly or indirectly, reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific Site feature. However, if we combine or connect Aggregated Data with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information, which will be used in accordance with this Privacy and Cookies Notice.

 


We do not collect any
Special Categories of Personal Information about you, unless specifically required for the provision of the Services (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. 

(b) If You Fail To Provide Personal Information

Where we need to collect Personal Information by law, or under the terms and conditions of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with Services). In this case, we may have to cancel a Service you have with us. If this occurs, we will notify you.

4. How we use your Personal Information

(a) Circumstances under which we will use your Personal Information

We will only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your Personal Information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

 

Most commonly, we will use your Personal Information in the following circumstances:

  • Where we need to perform the contract, we are about to enter into or have entered into with you.

     

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

     

  • Where we need to comply with a legal obligation.

     

Generally, we do not rely on consent as a legal basis for processing your Personal Information although we will get your consent before sending third party direct marketing communications to you via email. You have the right to withdraw consent to marketing at any time by contacting us.

 

(b) Contact you: 

 

We will use your personal information to: 

  • Communicate with you if you give us your clear, unambiguous, affirmative consent to contact you.
  • Process and fulfill your orders for goods and services. We may use this information to create and administer accounts, fulfill and record transactions, and provide you with related assistance (e.g., technical help, answer inquiries relating to Personal Information, etc.).
  • Customize the delivery of information to you. We may contact you if we feel you have a legitimate interest in hearing from us. For example, if you sign up for a webinar, we may send you marketing emails or texts based on the content of that webinar. You will always have the option to opt out of any of our emails or mobile text messages.

     

Provide Services: We may need to disclose this information to our integrated partners and service providers who provide services to us and our end users, such as Site hosting, data analysis, payment processing services, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, credit card processing, auditing and other similar services.

 

Monitor Services: We may use the information you provide to monitor your progress when using our Services. For example, for sending you reminder emails to complete your training or a course completion certificate when you have finished a workshop or course. 

 

Management of Employment and Contractors: For TFP employees and contractors, this means that we may use this information for establishing, managing the terms and conditions of your engagement, including the termination of any such engagement with TFP.

 

Research to Improve our Services: We occasionally use this information to generate statistics and aggregate reports for internal use. We may also use this information to conduct and publish research on the effectiveness of our Services. These statistics, aggregate reports, and research articles do not contain any personally identifiable information. Your identity (as well as your organization’s identity) will remain anonymous.

 

Run Targeted Social Media Advertisements: We may use the information you provide to us to run social media advertisements. 

 

Sharing with Third Parties: The information you provide on our Site is used only by TFP except in very limited circumstances. For example: 

  • If you are taking training sponsored by your organization, we may share some course registration information with your employer. 
  • TFP may disclose personal information if legally required to do so, or if necessary, to comply with legal process served on TFP, protect TFP’s rights or property, or take emergency action to protect the personal safety of users of the Site, LMS, workshops or the public, all in accordance with the applicable law.
  • TFP may disclose personal information in the context of a corporate or financing transaction. If TFP is involved in a sale or business transaction (e.g., merger or acquisition), we will retain a legitimate interest in disclosing or transferring your Personal Information to other parties in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), including in any negotiations leading to such. Such parties may include, for example, an acquiring or target entity and its advisors. In any such transaction, any Personal Information will only be transferred in necessary, and all such transfers shall be to persons under obligations of confidentiality. 


Communicating and Working with Others
: Note that whenever you voluntarily make your Personal Information available for viewing by others during in-person training or online through the Site or its content, it may be seen, collected and used by others, and therefore, we cannot be responsible for any unauthorized or improper use of the information that you voluntarily share (i.e., sharing a comment on a blog post, posting in a Facebook group that we manage, sharing details on a group coaching call, etc.).

 

Submission, Storage, Sharing and Transferring of Personal Information: Personal Information that you provide to us is stored internally or through a data management system. All Personal Information is stored in Canada. Your Personal Information will only be accessed by those who help to obtain, manage or store that information, or who have a legitimate need to know such Personal Information (i.e., our hosting provider, newsletter provider, payment processors or team members).

 

Please note that we may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use it for all the purposes for which we use and disclose Personal Information. In some instances, we may combine Other Information with Personal Information. If we combine any Other Information with Personal Information, we will treat the combined information as Personal Information.

5. Disclosures of your Personal Information

We may share your Personal Information with the parties set out below for the purposes set out in Section 4 – How we use your Personal Information.

  • Internal Third Parties as set out in the Glossary.

  • External Third Parties as set out in the Glossary.

  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Information in the same way as set out in this Privacy Terms.

We require all third parties to respect the security of your Personal Information and to treat it in accordance with the Law. We do not allow our third-party service providers to use your Personal Information for their own purposes and only permit them to process your Personal Information for specified purposes and in accordance with our instructions.

6. International transfers

It is important to note that we may transfer data internationally. For users in the European Union, please be aware that we transfer Personal Information outside of the European Union. By using our Services and providing us with your Personal Information, you consent to these transfers in accordance with this Privacy Terms.

 

 

Whenever we transfer your Personal Information out of the European Economic Area (“EEA”), we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your Personal Information to countries that have been deemed to provide an adequate level of protection for Personal Information by the European Commission. For example, Canada is recognised as affording an adequate level of protection for Personal Information by the European Commission. TFP is based in Canada and the majority of Personal Information is transferred between the EEA and Canada via the TFP platform.   • Where we use certain service providers, we may use specific contracts approved by the European Commission which give Personal Information the same protection it has in Europe.   • Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to Personal Information shared between Europe and the US. For further details, see European Commission: EU-US Privacy Shield.

7. Data security

We have put in place appropriate security measures to prevent your Personal Information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions, and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected Personal Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data retention

We will only retain your Personal Information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

 

To determine the appropriate retention period for Personal Information, we consider the amount, nature and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

 

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers.

In some circumstances we will anonymise your Personal Information, including your Aggregated Data, (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. 

 

9. Cookies

Since our Site uses cookies and/or other further identifiers (such as pixel or tag) for several purposes, this Privacy Terms sets out what cookies are and how they are used on the Site. Certain cookies and identifiers are conveyed and controlled by us directly. We collect and process your Personal Information by means of these cookies and identifiers.  

(a)What cookies are and what they are for?

Cookies are text files with small pieces of data — like a username and password — that are used to identify your computer as you use a computer network. Specific cookies known as HTTP cookies are used to identify specific users and improve your web browsing experience. Data stored in a cookie is created by the server upon your connection. This data is labeled with an ID unique to you and your computer.

 


Websites use cookies to streamline your web experiences. Without cookies, the user would have to login again after they leave a website and reselect their previous preferences. 

(b) How we use Cookies?

We summarise the types of cookies used on the Site below:

  • Strictly necessary cookies. These are cookies that are required for the operation of our Site. They include, for example, cookies that enable you to log into secure areas of our Site, use a shopping cart or make use of e-billing services. 

  • Analytical/performance cookies. They allow us to recognise and count the number of visitors and to see how visitors move around our Site when they are using it. This helps us to improve the way our Site works, for example, by ensuring that users are finding what they are looking for easily. 

  • Functionality cookies. These are used to recognise you when you return to our Site. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region).

  • Targeting cookies. These cookies record your visit to our Site, the pages you have visited and the links you have followed. We will use this information to make our Site and the advertising displayed on it more relevant to your interests. We may also share this information with third parties for this purpose.

Furthermore, removing the technical cookies could remove the preferences set up by using the Site or you could no longer find products or services included in your basket.

10. Glossary

In this Privacy Terms and Site Terms and Conditions, the following terms mean:

 

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Information for our legitimate interests. We do not use your Personal Information for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by Law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your Personal Information where it is necessary for compliance with a legal obligation that we are subject to.

Internal Third Parties means other companies in the TFP group, including affiliated entities, who are based in Canada and provide IT and system administration services and undertake leadership reporting.

External Third Parties include: 

  • Third parties whom you explicitly ask us to provide your Personal Information to for the potential or actual delivery of our brands, products and/or services.

  • Service providers (for example, IT services), business partners, suppliers and sub-contractors for the performance of any contract we enter into with you, but also when providing you with marketing communications.

  • Analytics and search engine providers that assist us in the improvement and optimisation of the Site.

  • Government or other law enforcement agencies, in connection with the investigation of unlawful activities or for other legal reasons (this may include requirement to share your location information).

  • Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

 

11. YOUR LEGAL RIGHTS

You have rights under data protection laws in relation to your Personal Information. In particular, you have the right to: 

 

Request access to your Personal Information (commonly known as a “data subject access request”). This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

 

Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

 

Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your Personal Information to comply with local Law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

 

Object to processing of your Personal Information where we are relying on our Legitimate Interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we may demonstrate that we have compelling lawful grounds to process your Personal Information which override your rights and freedoms.

 

Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios:

  • If you want us to establish your Personal Information’s accuracy.
  • Where our use of your Personal Information is unlawful, but you do not want us to erase it.
  • Where you need us to hold your Personal Information even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your Personal Information, but we need to verify whether we have overriding lawful grounds to use it.

Request the transfer of your Personal Information to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

 

Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent. If you wish to exercise any of Your Legal Rights, please contact the data privacy officer.

 

No fee usually required

 

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

 

What we may need from you

 

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

 

Time limit to respond

 

We try to respond to all legitimate requests within one month. Occasionally, it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

 

Changes to the Privacy and Cookies Notice and your duty to inform us of changes

 

It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes during your relationship with us. 

Submitting a Request: Where applicable law allows for such a right, if you would like to request access to, to correct, to object to the use of, to restrict or delete Personal Information that you have previously provided to us, or if you would like to request to receive an electronic copy of your Personal Information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), you may submit a request through our Site, LMS or at info@theforensicpractice.com with the subject line “Data Subject Request”. We will respond to your request consistent with applicable law.

 

How can I opt out of getting marketing and promotional material from TFP? 

 

Information we collect may be used by TFP for marketing purposes, such as one-off promotional emailing, mobile text messages, direct mail, and sales contacts.

If you are an End User of our Site and no longer want to receive marketing-related emails or mobile text messages from us on a going-forward basis, you may opt-out of receiving these marketing-related emails or mobile text messages by changing your preferences in your account settings or following the unsubscribe prompts from within the messages themselves. You can also unsubscribe or opt-out from our newsletter, updates, or promotional emails at any time by sending an email to info@theforensicpractice.com with the subject line “Unsubscribe from Marketing and Promotional Material.” 

If you have decided to opt-out from receiving marketing and promotional material, TFP will put in place processes to honor your request. This may entail keeping some information for the purpose of remembering that you have opted-out.

We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you do opt-out of receiving marketing-related emails from us, we may still send you messages for administrative, transactional or other purposes directly relating to your use of our Services, and you cannot opt-out from receiving those messages.

 

Social Media

 

Our Site and LMS includes social media features such as the Facebook Like button, and widgets, such as the Share This button or interactive mini-programs that run on our Site. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are shared with such third parties and governed by the privacy policy of the company providing it.

 

Testimonials, Ratings and Reviews
